Claim for the second reason.
I bought an item from outside the EU, which was offered as 'brand new' (new) and with free shipping, from a professional seller, not a private individual, with good ratings. The customs charges included a service fee from the transport company, FedEx, so I filed a refund request; since the final cost, with this unexpected fee, was higher than the local store price. Up to that point, I would have accepted it, if I ended up paying this extra charge. But I received the item today, in packaging that clearly had been opened before, and moreover, the item shows signs of use. But eBay won't let me make a second claim. I feel scammed and helpless. What can I do if there's fraud here but I can't file a claim?

Hello,
We’re sorry about what happened,
If the return request you initially opened has already been closed, unfortunately you won’t be able to open a new one, since it’s only possible to open one request per transaction.
If that request is still open, you can contact the seller so they can provide you with a solution, and remember that normally, according to our eBay Customer Guarantee eBay offers protection in situations where a buyer does not receive an order, or receives it in a condition different from what was described, as long as you open a request by selecting 'Item not as described' or 'Defective item' within 30 days after the delivery date, and if the seller does not respond to you or offer a solution, after 3 business days you can ask us for help so that we can try to find a solution for you.

OP2 years agoSo, I have been scammed in an e-commerce purchase, and I will not receive any help from eBay, because I made a claim for a known reason, without knowing that there was another reason, unknown and more serious. There is a perversion in this single-claim rule, which seriously harms the buyer. I will post it on my social media, so that at least others do not make the mistake of trusting eBay's help. And of course I will file a lawsuit for fraud against the seller.

OP2 years agoWhere is the warning that it is not possible to make a second claim in the same order stated?

We’re sorry to read your comments, and not to be able to give you a different answer.
We will give you one last answer, once again emphasizing that at eBay we place great emphasis on offering protection to our users in the event of an incident with a purchase.
In this guide you will find all the information related to our Customer Guarantee Program, and in particular you will be able to find the requested information in the 'Duplicate claims' section.

OP2 years agoYou can spare yourselves the pretence. I’ve already gone where I should have gone from the start: lawyer and lawsuit for fraud. And anyone who reads this should know they’ll have to do the same, since eBay is limited to offering supposed support, which isn’t really support at all, for image reasons and to avoid reputational damage. They’ll only waste your time with successive communications until the legal deadline to file a complaint against the seller expires. That’s what they tried to do with me.
