Purchase protection
How can I file a complaint with the court on eBay? I bought a mop, it has a 3-year warranty. It broke in 1 week. I returned it to the seller. The seller disappeared from eBay, did not refund the money, eBay does not give the seller's phone number. This is a scam involving eBay.

·3 years agoIn my case it was a Dyson hair dryer, which broke before the warranty ended, the seller doesn't show up, I assume they no longer sell on eBay, I sent it to Dyson's after-sales service and they can't fix it because they detected that it's a fake and they sent me the report. I sent it to eBay, but they don't reply. According to their policy, they don't sell counterfeit items.

·3 years agoeBay, as the intermediary between seller and buyer, is responsible for the product warranty. I would file a claim with eBay through some method that leaves a record. That is, by email, as long as it gives you a copy, either because you use your own email directly or because it’s a website that sends a copy of the claim to your email, or by contacting eBay by phone and recording the conversation (as long as you don’t publish it and you are a party to it, according to data protection law you wouldn’t have to say that you’re recording it). Once that’s done, then go to the consumer affairs page or office of your town council or Autonomous Community and file a claim, providing the details of the claim made with eBay. They have 6 months to answer you. Normally, in such a clear case, eBay will try to reply before that to reach an agreement.
In any case, with the eBay purchase receipt, you can go to the manufacturer’s after-sales service and force them, within the 2 years after purchase, to repair the product. If they refuse to repair the product for free within the 6 months following the purchase (receipt of the item), it will be they who have to prove, if you take them to court, that the problem with the product is due to misuse and not a manufacturing defect.

Even if I filed the complaint personally in Perry Mason court, I would still manage to win the case.
